These Terms of Service ("Terms") govern your use of The Letter Tree website and services operated by The Letter Tree ("we", "us", or "our"). By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully.

1. Our Service

The Letter Tree provides a handwritten letter mailing service. You submit a letter and a recipient's mailing address through our website; we then handwrite your letter on quality paper and physically mail it to the recipient via postal mail anywhere in the world. Our service fee is USD $39.00 per letter, which covers handwriting, materials, and standard international postage.

2. Eligibility

You must be at least 18 years old to place an order, or have the consent of a parent or guardian. By using our service, you represent that you are of legal age to form a binding contract. You are responsible for ensuring the information you provide is accurate and complete.

3. Orders and Payment

• All prices are in US Dollars (USD). Payment is processed securely through Stripe. We do not store your credit card information.
• Your order is confirmed only after your payment has been successfully processed and you receive an order number on our confirmation page.
• You agree to provide current, complete, and accurate purchase and account information for all orders.
• We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, prohibited content, or inaccurate recipient information. In such cases, a full refund will be issued.

4. Mailing and Delivery

• Letters are typically handwritten and mailed within 3 to 7 business days after payment confirmation.
• Once a letter is handed to the postal service, delivery times are outside our control. Domestic delivery generally takes 3–10 business days; international delivery may take 7–21 business days depending on the destination country and customs processing.
• We are not responsible for delays caused by postal services, customs, incorrect or incomplete addresses provided by you, or force majeure events.
• Please ensure the recipient's address is complete and accurate, including apartment/suite numbers and correct postal codes. Letters returned to us due to an incorrect address may be remailed at an additional postage charge.

5. Acceptable Use and Content Policy

You agree not to use our service to send content that:

• Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, or invasive of another's privacy;
• Constitutes hate speech, discrimination, or incitement to violence;
• Infringes on the intellectual property rights of any party;
• Contains malware, spam, chain letters, pyramid schemes, or unsolicited commercial messages;
• Impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity;
• Contains sexually explicit material involving minors, or any content that exploits or harms children.

We reserve the right to refuse service, cancel orders, and report unlawful content to appropriate authorities without refund. We do not pre-screen every letter, but we may review content if a violation is reported or suspected.

6. Refund Policy

• Before mailing: If your letter has not yet been handwritten or mailed, you may request a full refund by contacting us with your order number.
• After mailing: Once a letter has been handwritten and mailed, we cannot offer a refund, as the service has been fulfilled.
• Non-delivery: If a letter is confirmed lost in the mail and never delivered, we will, at our discretion, either resend the letter at no additional cost or issue a refund. We may require reasonable evidence of non-delivery.
• Refunds are processed to the original payment method within 5–10 business days.

7. Intellectual Property

The content, design, logos, and code on The Letter Tree website are owned by us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our website without our written permission. You retain ownership of the content of your letters; by submitting a letter, you grant us a limited license to handwrite and mail it solely for the purpose of fulfilling your order.

8. Disclaimers

Our service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure. We are not responsible for the content of your letters or for any emotional or personal consequences arising from their delivery or non-delivery.

9. Limitation of Liability

To the maximum extent permitted by law, The Letter Tree and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim shall not exceed the amount you paid for the order in question.

10. Indemnification

You agree to indemnify and hold harmless The Letter Tree and its operators from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of our service after changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Hong Kong.
